Robin I. Frank is a senior associate and devotes her practice to the areas of commercial litigation, labor and employment law and real estate litigation. She is admitted to practice before all state courts in Florida, as well as the United States District Court for the Southern and Middle Districts of Florida and the United States Eleventh Circuit Court of Appeals. She also represents clients in alternative dispute forums, such as mediation and arbitration.
Ms. Frank was recognized as one of the top up and coming young attorneys in the South Florida Legal Guide 2008 and 2009. Ms. Frank was also recognized as a Florida Rising Star for labor and employment law in the 2009 Florida Super Lawyers magazine.
Ms. Frank received her Bachelor of Arts in Business Administration, summa cum laude, from Florida Atlantic University and her Juris Doctor, magna cum laude, from the University of Miami School of Law. She also received the highest score on the Florida Bar Exam for the Fourth District Court of Appeals.
Her labor and employment practice focuses on the litigation of labor and employment disputes, including non-compete agreements, discrimination, harassment and retaliation claims involving race, national origin, ethnicity and gender. Ms. Frank further litigates Family and Medical Leave Act claims, whistle-blower claims, workers’ compensation retaliation claims, and minimum wage and overtime compensation claims, including collective action overtime compensation claims. Ms. Frank also counsels clients, particularly employers, on preventive labor matters, including drafting and employing proper policies and manuals.
In the commercial litigation aspect of her practice, Ms. Frank focuses on complex business and commercial litigation issues, including breach of contract claims, trademark infringement claims, commercial landlord and tenant issues and real estate and business torts.
In the real estate litigation aspect of her practice, Ms. Frank handles all types of litigation based upon real property and real estate deals gone bad, including partition claims, breach of real estate contracts, specific performance of real estate contracts, fraud claims involving the sale and purchase of real property, and claims arising under various consumer protection laws. Ms. Frank devotes a large part of her real estate litigation practice to representing and assisting buyers in pre-construction real property contracts seeking to either revoke or rescind the sales contract, to recover deposits paid by the buyers to the seller/developer and to recover any other damages the buyers have incurred where builders or developers have failed to comply with the requirements of the law, most notably the Federal Interstate Land Sales Full Disclosure Act and the Florida Condominium Act.
