Congratulations to Stuart Weinstein and Laura Eggnatz in achieving an excellent outcome for the firm and its client, Georgia-Pacific. In a recent decision, the Florida Supreme Court rejected plaintiff’s petition to reverse the Fourth District Court of Appeal’s opinion in Kelly v. Georgia-Pacific, LLC, et al., meaning the Fourth DCA’s opinion is now the law in Florida. This ruling gives finality and a positive end result for the firm’s client and also provides future guidance by specifically limiting the liability of any entity being sued for injuries that occurred prior to a marriage, even when those injuries result in death.
The law is now clear: in order to pursue consortium damages in a suit for either negligence or for wrongful death, a consortium claimant must have been married to the plaintiff at the time of the initial injury.
