On February 23, 2017, Florida’s Fourth District Court of Appeal affirmed an order enforcing a mediated settlement agreement, which was executed by the wife of an incapacitated business owner under a durable power of attorney. The wife sought to “undo” the agreement on grounds that she lacked the requisite authority to enter into the agreement pursuant to Florida’s Guardianship Statutes where a guardianship proceeding was pending. At the trial court level, the attorneys at Shapiro, Blasi, Wasserman & Hermann successfully enforced the settlement agreement. When the wife appealed that ruling, the Fourth District Court of Appeal per curiam affirmed the trial court’s order. This is a significant victory for the firm’s client.
Firm attorneys Andrew B. Blasi, Robert E. Sacks and Robin I. Frank handled the appeal and represented the client in the underlying litigation. Shapiro, Blasi, Wasserman & Hermann, P.A. represents clients in all facets of commercial and business litigation throughout the state and federal courts in Florida.
